Minimum Wage and Exemption Law – Overtime Requirements

On July 15, 2020, the Colorado Department of Labor updated the Colorado Overtime and Minimum Pay Standards Order (COMPS ORDER) #36. Included in this COMPS ORDER are the requirements for overtime coverage and exemptions for employees. Under the COMPS ORDER, weekly overtime-exempt salary rates greatly increase to the following:

January 1, 2021$778.85 per week or $40,500 per year
January 1, 2022$865.38 per week or $45,000 per year
January 1, 2023$961.54 per week or $50,000 per year
January 1, 2024$1,057.69 per week or $55,000 per year

The COMPS ORDER includes additional requirements for hourly workers for many different subjects including, but not limited to, breaks and overtime.
